Article 1: Object

In order to satisfy the buyer, HELIPASS.COM may have to change the present general terms and conditions of sale as well as its product ranges. Changes will be brought to the attention of the buyer through their online consultation.

Article 2: Order confirmation and contract

The acceptance of the offer by the buyer is concretized by the electronic validation of the total amount of the order and the associated costs, as well as the information to be completed to ensure the delivery and the contact with the buyer: Last name First name Billing address Delivery address E-mail address Telephone number. The conclusion of the contract is only effective after the order confirmation by HELIPASS.COM. Article 3: Pricing and payment terms

The amount to be paid by the buyer means the TTC price of the products and the TTC shipping costs. Prices are expressed in euro (€). The applicable VAT rate is that in force on the day of the order. The prices posted on the site may be revised according to economic conditions. The products will be invoiced on the basis of the prices in force at the time of registration of your order. Regardless of the method of payment, payments are made in euros. Individual buyers will have to pay the amount of their online order by credit card (Credit Cards, Visa, MasterCard, American Express). In a 100% secure environment, you can make your payments safely. The information is encrypted directly by the banking institution. The order validated by the buyer will be considered as effective only when the banking payment centers concerned have given their agreement. Payments made in line by credit card will be made through the secure system that uses the SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by a software. In the absence of a bank provision, refusal of the said centres, the order will be automatically cancelled. Payment by cheque is accepted exclusively in the context of an order whose contours have been previously validated by HELIPASS.COM In case of special or custom request, an estimate is established by Helipass. The prices and availability presented on the quotations are not binding and are given for information purposes before the conclusion of the contract.

Article 4: Cancellation rights

In accordance with article L.121-18-4 ° of the Consumer Code, you do not have a right of withdrawal after accepting this contract.

Article 5: Flight terms

Passengers must present themselves at the time indicated on their boarding pass and be provided with an identity document (identity card or passport) and their boarding pass. Documentary recognition is carried out before boarding.

Article 6: Flight delay

Article 6A: Postponement of the flight The flight may be postponed for weather reasons if the minima (visibility and ceiling) are not met or for technical and operational reasons. In this case, an email and a text message are sent to each passenger. Helipass offers an additional 30 days of validity if the ticket expires within 30 days of the postponement. If your e-ticket is valid for more than 30 days, the date indicated remains valid. Since aviation requires good weather and operational conditions, flights can be postponed to the last minute. Article 6B: Postponement of the flight by the customer No cancellation or postponement on the part of the customer and/or passenger can be taken into account if it occurs less than 3 weeks, or 21 days before the scheduled date of the flight.

Article 7: Validity date and extension

The validity date indicated on the ticket corresponds to a deadline for booking the flight. Until the expiration of the validity of his ticket, the customer has the possibility of extending the validity of his ticket by 3 months for an administrative fee of € 29.90.

Article 8: Repayment conditions

Any refund request must be made by e-mail to serviceclient@helipass.com, this request will be reviewed by Helipass. Please provide invoice, mailing address and bank details. If the refund request falls within the general terms and conditions of sale, Helipass will refund the voucher within 30 days end of month after acceptance of the request. Refund only in the name of the Person who made the purchase on the method of payment used. If the customer has booked through a third party, the third party will be responsible for the transfer of any refund. Helipass is not responsible for any fees that the agency may charge for processing the refund. Tickets purchased through Helipass’ distribution network are subject to the their own terms and conditions. No refunds will be made by Helipass. Tickets purchased directly on the Helipass platform are non-refundable. Except in special cases on presentation of proof: - death: of yourself, your spouse by right or common-law partner/ of your ascendants or descendants, in the 2nd degree, and/or those of your spouse by right or common-law partner - case of major force - medical reason If a refund request is accepted, Helipass agrees to refund the ticket price, excluding any ancillary expenses. Registration fees are non-refundable.

Article 9: Change of beneficiary or flight

Article 9A: Change of beneficiary Tickets may be assigned to another people. Please contact Helipass in order to proceed to the name change. Article 9B: Flight Change The customer may change flights to another available destination. If the new rate is higher than the original rate, the customer will have to pay the difference. If the new fare is lower than the original fare, Helipass will not refund the difference.

Article 10: Deferred Guarantee

If the customer wishes to change their helicopter flight date, the “Warranty Report” option allows them to extend the flight date up to one week (seven days) before the chosen flight date. The "Garantie Report" option must be purchased before the service at a price of €19.90 including all taxes.

Article 11 : Force majeure

The liability of either party cannot be sought if the performance of the contract is delayed or prevented due to force majeure. In this respect, force majeure extends from any external event, unforeseeable within the meaning of Article 1148 of the Civil Code. Expressly, are considered as force majeure or fortuitous cases, in addition to those usually adopted by the jurisprudence of the French courts and tribunals.

Article 12: Evolution of General Conditions

HELIPASS.COM reserves the right to modify these terms and conditions at any time by publishing a new version that will be applicable to any order placed after its first posting on the website. Article 13: Applicable Law and Jurisdiction Sales of HELIPASS.COM products are subject to French law. Any dispute relating to the interpretation, performance or termination of the contract concluded between HELIPASS.COM and the buyer, even in the case of multiple defendants, shall, in the absence of an amicable agreement, be the exclusive jurisdiction of the courts of Paris.
